LD ODD ADHD a BIP that was never implemented and a useless IEP

My 17yr old son is LD, reading and math, Ed and other coded by the district. He had a FBA and a complete psycho-ed eval last year. He is reading at th 2nd grade level and a proscritive program was suggested at a team meeting where a "DRAFT" IEP and BIP was presented. HE was placed in a local school for emotionally disturbed kids and was allowed to go to the main school for vocational and reading. I foolishly signed an IEP in June but asked where all the provisions were and they said they would get back to me. He was getting in trouble left and right. This year he was suspended on the second day then when he returned he had a flare up and they suspended him for 5 days asked for a safety assessment to be done. I agreed but they let him back into school pending my seeing the docs supplied to the psych. 3 wks later he called a girl a name now on indefinte suspension (33 days now)pending eval. I discovered that the draft IEP was not implemented..mediation is coming they do not want him back

I believe you can ask for up to 2 years of compensatory education for lack of the schools providing FAPE, so you can seek out of district private placement....and it seems to me like that's the best option you have, because any teen who reads at the 2nd grade level, assuming he has otherwise average intelligence, has clearly got a lot to make up in a short period of time. I'd recommend joining www.millermom.proboards107.com and asking some of those "seasoned parents" for advice.

He has had an IEP since 2nd grade I was in a very toxic marriage and she would take off with the kids all the time hanking them in and out of schools andthey suffered. But before no child left behind there was no accountability in special education He was passed through as they said there was nothing they could do.. Last year he was re-tested because of escallating behavior problems. They found the core reading problem and proscribed a reading program just never wrote it into the IEP along with no services transitional vocational or special education. I signed it because the 1st 2 pages jived with the draft IEP tey presented me at a team meeting. Now he is actin up more has since the 2nd day of school this year. I am in NH only 3 or 4 good lawyers in the state able to go to due process and miine isn't one of them the others are booked NH worst state at Sped dropout rate HELP

I'm dumbfounded, because it sounds like your son was JUST identified last year as needing an IEP? If he's only reading at a 2nd grade level, I don't understand why he wasn't on an IEP from 3rd grade until now? While you say you have a lawyer, it doesn't sound like he/she is a special education attorney...I would recommend contacting someone through www.copaa.org/find/index.php
What state are you located in? There is another forum that has some pretty knowledgeable parents when it comes to navigating the special ed system, including some that have represented themselves in manifestation determination hearings, etc. so you might want to join www.millermom.proboards107.com to ask them, too.

The reading program that they suggested was never put in place they put him in an advanced reading class and he has had no tutoring for his general ed/vocational class. No vocational people or transition people have been part of the team and the school psychologist was taken off the team perhaps because he would question why the BIP, which he drew up, was never implemented. He has been a problem child since he quit taking his meds three years ago. But I just go him back on his Stratera a miracle drug for him since fourth grade. I have a lawyer yet he has never been to mediation. I asked for an IEP meeting on August 18th via a replied to email and have yet to have one they said because of 2 manifestation meetings this year that is enough. This is a frustrating situation. I am appalled by the LEA attitude and their treating him this way what would 504 do for him. We applied for educational guardianship a hearing is on his 18th Bday.
