First of all, I'd be sure you've kept a written "documentation record" of the kind of violations your child has experienced. It's critical when dealing with special education situations, to have factual details. Have you already tried to contact your child's case manager, to ask why the IEP isn't being followed? Have you tried to request another IEP team meeting? Unfortunately, it's best to give the school the opportunity to address the problem, before pursuing a legal complaint process. Sometimes, just showing up with an advocate, or mentioning that you plan to hire an attorney, is enough to get the schools to become more compliant. Do not waste your time with requesting a new IEP or showing up with an attorney or advocate . If the school district failed to implement the IEP it is the violation of the law. Call to California Department of Education at 800-926-0648 or go to their website to find the complaint form and file the complaint immediately.I also would recommend the book Special Education.
