I have identical twins that are IEP classified students with ADD/HD they cant advantage of support services GPAs are 2.5 and 2.34 one was denied entrance in a program b/c of GPA is this discriminatory because she is LD and could not get services?
I know what is stated is not what happens..but i have twins in the same school and they have already lost their academic money because of lack of services for the athletes..and each class is very pricy...just thought i would get some feedback thanks for answering
I know that what is "advertised" when students are looking at colleges, and what actually happens once they arrive are not always the same. In my son's case, the experienced Disabilities Coordinator promised several things, and then she quit unexpectedly right before he started his Freshman year. The new person hired to replace the old Coordinator had virtually no experience, and couldn't even advise my son how to drop a class by the withdrawl deadline, so he got a failing grade due to her misinformation. We contacted the Dean's Office to explain my son's situation, and they did change the "F" to a "Withdraw" so his GPA looks better now, but he still needs to retake the class. He is not getting the kind of support that was promised from his Disabilities Office, either.
As I mentioned before, couldn't your daughter retake a class for a better grade, and wouldn't the new grade substitute for the old, so her GPA could improve from 2.4 to 2.5 and she can reapply to the teaching program? Aren't there other majors she can still go into, with less than a 2.5?
They are on athletic scholarship...and were told upon entering that services were available..they are not for those students who participate in athletics because of practice and game schedules...they have been told two chose between the two..but they cannot afford to forfeit the athletic money that is the dilemma for them and as they are ADD/HD students the rigor of the athletics helps them in the classroom
This is always murky waters but in this case, you'll be told the services are available. It's not that the services are not provided - it's that the girls choose not to utilize them.
I understand how important athletics are but that won't change the law. This school does provide services and does not intend to discrimate against the girls.
ADA is adament that established standards need not be lowered so the school will be on safe grounds sticking to the GPA requirement.

Thank you for the clarification. I have a strong background in special education issues, but I don't have any specific knowledge regarding athletic programs and the situation you're in. I believe that although FAFSA is a federal program, eligible students are the ones "receiving" the funding; the school only gets the money on the student's behalf if that student enrolls. That's different from K-12 public programs where a school gets federal money for every student based on "headcount" but not on a specific student.

Just speaking parent-to-parent, could your daughter who was refused entry to the teaching program based on GPA re-apply in the future? Does her school allow students to retake courses for improved grades? (My son's college allows up to 3 classes to be "retaken" for that purpose, with the new grade substituting for the old.) Could she take a class over the summer and perhaps raise her GPA that way? (My son seems to get better grades when he takes a class in summer, since he doesn't have other courses to study for.)
the girls play D2 ball at a 4 year private school therefore when services are available they are either at practice or playing additionally testing mods are difficult b/c they have such a tight schedule due to their athletic schedule..so the girls have been muddling through on their own..I have called everyone and each time the answer is they have to chose softball or academics..unfortunately for Devin she was denied entrance into the teaching program b/c she only had a 2.34 GPA and needed a 2.5 my question is Is Devin protected under the ADA or 504 for a "reasonable accommodation that does not disrupt a program or discrimination due to her disability." Does FASFA count as federal funds for a private school?

I hope you don't mind clarifying things...are your girls at a state university of some kind, or is it a private college? 2-year or 4-year degree program? I'm very confused about why being softball players means that services are not available to them? Who has always been telling them to make a choice? A choice between what? Getting services and playing sports??? What program were they denied entrance to?

The girls are softball players in college and services are not available to them...they have always been told to make a choice..they do not want to make a choice softball helps them focus but can a college deny a student a program if it is a reasonable accomodation request under ADA or 504
