special education students can be retained?

I went to a GPC meeting today where they stated that my son would be retained even though hes in special ed because he failed the reading portion of the taks m. plus they felt he lacked the skills to grasp the context of what hes being taught. i asked them if he had been enrolled in their school beginning of the school year and fully enrolled in special ed did they feel he would be at grade level now. they said yes. so why cant he be placed into the 5th grade and be at grade level next year? They say he's at 1st grade level but passed the Math regular taks last year. and passed it again this year with taks M. they say he scored low on the reading portion and didnt feel he would make it through 5th grade.No summer school or tutoring was ever offered, just retention. he transferred from another school mid school year They said they were not at fault that paperwork took so long. Well neither is my son.
Is it possible to overturn that decision?

I would start by calling your state board of education and see what the state laws and policies suggest. A child with a disability is not going to learn at the same pace as their peers, they feel he should be at grade level in one year...that's a true miracle and they are full of it...gatekeeping at it's worst.
If your son is not reaching his goals and benchmarks that means they are not providing him the supports he needs and one test should not justify their reasoning for retention.
Of course a child who is behind in reading is not going to perform well on a state test that is tailored for 4th graders.
They dropped the ball and they are making up excuses. Yes, fight this!
