Can anyone tell me how to handle something, my son's art teacher hit him in the head with a chair and caused a

gash in his head,the principal verified that the teacher hit him, do i need to get an attorney for this matter i have already press charges. will the school also be reliable for this incident

I was wondering how it was going? You should get the entire story from your child's point of view. The story from the teacher's point of view. Report it to the principal via a formal request form and request it be reported in writing to the superintendent immediately. If this was not accidental, I would request the teacher be removed immediately for negligent conduct . Then you need to contact the mass education website for further instruction (formal complaint to the school district or state or retain an attorney that specializes in such cases if you do not get any satisfaction. The most important thing is to have everything document, dates, photos etc. just in case. I am only a couple of towns from Mansfield. My sister used to live there and she is now a teacher in Taunton. You need to file reports and keep documentation even if you do not sue, just in case something were to happen later.

Yes thats correct, sorry did not refer the abbreviations correctly. They handle a lot of things with abuse..esp if school does not handle it correctly.

As a state employee of a school, policies require that if any incident is involved in this, CPS should be contacted, and they will handle all the issues and tell you what can be done as well, someone there should have sent him to the nurse and the nurse is required by law to take a picture of the injury and document what she sees, measure the gash, what it looks like etc. That will be a document that can be previewed by both principal/administrator/parent. Its a very good policies. We have had kids gotten hurt by staff, student and other stuff, equipment. I know a story where a teacher had to hold a chair up against the student because the student was aggressive toward to the staff, and she had to protect her self, she did not do anything but hold it between them, and he was the one that rammed into the chair, as well teacher got hurt too. So there are things we need to know before we jump the gun and make accusations, because that can be more harmful to both parties if accusasation becomes wrong information if you know what I mean. Im not saying your child is aggressive, but just pointing out that there is always stories behind incidents. I sure hope nothing serious with your boy and that he is ok now.

Get an attorney and sue the individual and the district that hired the lunatic! Not only should the shcool pay for your son's medical bills, but he may need councelling now or in the future. Do not drop the charges on the person attacking your son!

AND "YES" "THE SCHOOL" SHOULD PAY ALL OF YOUR "MEDICAL BILLS." They are responsible for your child's safety, ESPECIALLY with a "TEACHER" throwing stuff.

as healthy11 stated your primary concern is your son's physical and mental health make sure he sees a health care professional take pictures document all conversations with the Principal ect. You have already pressed charges.

Again: Concern #1 get your Son to Health Care Professionals.

I do have a question. Did they do any test such as a "C.A.T. SCAN"? or a M.I.R.? They probably needed to. You posted your question on 12/19/07. Did it happen that day? If he is still complaining, i would take him back to the same "emergency room or Doctor office tomorrow, if they are open on week-ends.

Did you take him to a doctor right after the injury? If you still have such serious concerns, and your son is in such distress, you could take him to a hospital emergency room. At the very least, does your doctor have a 24-hour number where someone is "on call" and can tell you if the level of discomfort that your son is feeling is normal? (Very often the day after an injury a person feels worse, because when it first happens, adrenaline and shock make a person "numb.")

and yes i have documented everything and i also write down the time i recvd the call from the nurse and spoke to the teacher and the police officer. which the police have gotten statements from the students and anyone else who was involved...thank you

"sgadling32" That is what i was refering to...in my 2 cents worth , about my brother and my son's "BAND TEACHER", and HE IS STILL TEACHING---he just has not hit anyone YET. My brother graduated in "1990". My son was going there in "1997" and he is still thowing stuff???? I JUST DO NOT GET IT???

As I mentioned earlier, you NEED to document everything in writing, and not rely on phone calls. If you have not already done so, take photos of your son's injury, too, and keep it with the doctor's report....Since they are not responding readily, perhaps you would be wise to get an attorney.

well the teacher left the school immediately.and didnt return for next period the principle have not talked to him in person only over the phone .the teacher claims to be emotional distress. he actually took my son out of the classroom and when he saw the blood allover my son's face and head he panic and start hitting the walls and screaming and ran out of the building. i have called the school but cant get anyone to return my calls and i have also notified the school district still no responce.

well from the police report and statements the teacher threw the chair because the kids wouldnt stop horse playing in class. so i am taken he threw it to get their attention to stop. and the reason why the kids were playing around becausse it was a free day since they will not be coming back to his class since the semester had ended.so at the end of the day whatever the child or children were doing you dont throw something at anyone to make them stop or get their attention.

Okay if i had to take actions i would go to the school and visit with the art teacher and then after a couple days later go back to your sons school and have a sit down with the art teacher and the princple and your spouse and your son

I hope your son is okay. Just wanted to express my condolences. What were the circumstances that resulted in your child being hit by the chair? I mean was the teacher moving a chair and accidentally hit your child in the head, was a chair thrown at your child by the teacher, or something in between? The context of the situation might have bearing on your actions.

I TOTALLY AGREE with "healthy11", but i just want to put my 2 cents in as, a example.... When my son went to" PUBLIC SCHOOL", he was telling me his "BAND TEACHER" threw stuff, i ignored it "like yea right", well., my brother, went there also "years ago", and then came "Christmas", family, get together, and they got to talking "TURNS OUT " My brother said "yes", he did through stuff. BOTTOM, line, just because, they are a Teacher, does not make them "wonderful". I would press charges, which "i believe, you said "you did". I think, that is great.

I hope you took your son to a doctor and he is okay. When you say will the school be reliable, I think you mean liable, but I'm not sure what you're asking for. I would hope that paying your son's medical costs and firing the teacher would happen without having to hire a lawyer. If you want to seek additional civil damages, you might need your own attorney, otherwise when you go to criminal court, you will automatically be represented by a State's Attorney.
In any case, if you haven't already documented what has happened thusfar with written documentation, you need to do so. List as many facts as you can
about what happened, where, when, who did what to whom, who witnessed it, etc. Also indicate what happened after the incident, and include mention of the principal verifying that the teacher your son. This letter should be sent to your school district superintendent stating what you expect to happen, but again, you might want to consult with a lawyer if there's something you're seeking beyond just having the teacher fired and your medical costs paid for. I'm not sure what's required to have the state revoke the person's teaching certification.
In the criminal court, the judge will sentence the teacher to either jail time, or public service, perhaps anger management classes, etc.
You might try posting your question on www.lawguru.com and say which state you live in, then see if other lawyers reply.
