can a pre-k be retained

my son just only been in school for 3 months and all the parents recieved a letter stating that pre-k through kindergarden will be retained if they missed 15 days excused or unexcused, and if there grade level is 1 or 2 which means 1 is way below average and 2 is below average . i approach the teacher about it and then she says well just try to get him to school worry about that. but on the letter it qoutes that it was counted by the principle, my son attends a charter school in washinton,dc .I was approached by the assitant teacher today that he had 17 tardys. school is from 8:00am to 3:30 pm . and a tardy slip is givin to students when they are 5 minutes late and many minutes after that. well she qoutes that 3 tardy slips equals to 1 absent day. I 'm like what excuse me. I thought tardy passes are for you to be excused for being late for class not missing days of school. he has progressed in school very well . but this mad me very angry. what do you think about this?
