WHAT THEY TOLD YOU IS NOT LEGALLY BASED. FIRST, THIS IS YOUR CHILD, AND IF THE TEACHER CANNOT SEEM TO HAVE THE ABILITIES OR INTELLECTUAL GIFTS TO TEACH THE CLASSROOM, YOUR WISH TO BRING IN A TUTOR IS VERY, VERY LOGICALLY BASED. FURTHER, I WOULD POSE THIS VERY QUESTION TO THEIR ACADEMIC GROUP AND LET THEM EXPLAIN THEIR WAY OUT OF THE SITUATION. IF THEY WERE COMPETENT OR ACTUALLY ABLE TO TEACH, NOT ONLY YOUR CHILD BUT THE OTHERS, I WOULD THINK THAT AN EXTRA SET OF HANDS IN THE CLASSROOM WOULD BE WELCOMED.
FURTHER, I WOULD BE IN CONTACT WITH YOUR CHILD'S SPECIAL EDUCATION LIAISON REGARDING THIS SITUATION. YOU CAN CALL THE USD 259 OFFICES AND REQUEST TO SPEAK TO THE LIAISON FOR THAT SCHOOL.
GET YOUR CHILD TO HER PRIMARY CARE PROVIDER, IDEALLY SOME ONE TRAINED IN PSYCHIATRY TO BE EVALUATED. I AM NOT TALKING ABOUT YOUR CHILD TAKING MEDICATIONS BUT HAVING THIS CLINICIAN WRITE A MEDICAL RECOMMENDATION THAT SHE BE EVALUATED FOR AN IEP AND OR 504 AS IT SOUNDS AS IF HER LIFE TRAUMAS SLOWED SOME OF HER PROGRESS. WITH ONE OF THESE IN PLACE, YOUR CHILD IS LEGALLY ENTITLED TO EXTENDED SUPPORTS FOR HER ACADEMIC ENDEAVORS. FURTHER, THE SCHOOL IS LEGALLY BOUND TO PROVIDE THESE SERVICES AS THIS IS A LEGAL DOCUMENT. GOOD LUCK TO YOU!! YOUR CHILD IS SO VERY BLESSED TO HAVE SUCH A STRONG ADVOCATE FOR HER.

My grandaughter goes to Seltzer and I find that they are really "their policy first" rather than listening to a parents view point. My GD had a "helper" from mental health dept. come with her last year to school and they kicked the attendant helper out of class saying that it was a "disruption to the teacher's class". by chance who is the teacher? You can email on the other group too if you like; the Learning and Attention group.

Hi. You aren't the first person who has encountered this type of situation. I'd really like to suggest that you join and repost your questions in the Learning and Attention Difficulties Group at community.greatschools.net/groups/11554

There are "child find" laws that are supposed to identify kids who have learning difficulties and provide help early. What reason did the school give for refusing? What type of testing was done? If you were willing to post your daughter's evaluation results in the group I mentioned above, other parents can give you their analysis.

As far as bringing a tutor in, the schools may say that in addition to the disruption in your daughter's class, there are security and liability issues (to allow a non-school employee in the building does pose some concerns.)

Does your daughter attend kindergarten all day? Could you just have her attend half-day, and then be with the tutor? Is pulling her out entirely for this year, and just "homeschooling" with help from the tutor an option?

Rather than answering my questions here, please do elaborate in a new post in the Learning and Attention Group....I'll look for you there.
