Is there a time limit for an LEA to reply with PWN?

We made a written requests for additional services at my sons last IEP meeting in June so he can receive FAPE this school year. We did this because he has met only 20% of his IEP goals the past 3 years and believe additional supports and services are necessary in order for him to access educational benefit. Is there a "clock" on the district to accept the requests or provide PWN? It has gone "up" to the Special Ed Dept at the district level for "review" but is being sent "back down" for another IEP meeting. Seems like a stall tactic.

Absolutely. School began today and all parties have already agreed to an IEP this Friday - record timing - after my letter to the district last week. PWN will come after that if needed. Appreciate your comments.

I submitted a written PWN yesterday regarding a placement issue where a change of placement occurred without an IEP meeting or parental notification and consent.

To the district's credit, I had a phone call before the end of the school day. Our disagreement hasn't been resolved but a written request gets attention.

We have not requested PWN in writing yet.

Yes, they must respond to your request for a Prior Written Notice (PWN) within ten school days.

Have you made your request for a PWN in writing? If not, they can pretend you didn't ask so they don't have to respond. If you did and they're ignoring you, send them a copy of your request along with a copy of your complaint to the state.
