If your child has an IEP, there are legal channels that you can use. It is critically important to have a written documentation record of events. I am not familiar with Benjamin Franklin School, but you should first schedule a meeting with your children's teachers, and the school administrator who works with special ed students. Let them know, in writing, specifically where they aren't complying. Have them confirm, in writing, how they are going to rectify the situation.

If they are not working with you, I suggest calling the school system themselves. Any time I have a problem, that is what I do and they get right on it for me.

Does your child have an IEP or a 504 plan? Assuming you have met with the teacher already, make an appointment with the principal and the teacher together. Be specific about what you are looking for and what you feel has and has not been addressed. Record the date, time that you met and who was at the meeting. If you need to progress further, I suggest writing a letter to the school district Head of Special Education and cc a copy to the Superintendent, principal and teacher outlining the problem you are having and what you are requesting.

If that doesn't get you where you need to be, you may find it necessary to pull in an advocate and suggest that a "Fair Hearing" may help resolve the issues. Hopefully you won't have to go that far, but in case you do the best thing to do is document every phone call and meeting with date, time and content and copy every note you send.These things will help support your case.

Is your child on an IEP? Are they complying with it? Have you expressed your concerns to them? What was the reaction, did anything change.

If they have major violations of an IEP (withholding services, modifications, accommodations) I would put them on notice by writing them a letter outlining the issues. I would request reassurance in writing that the issues will be resolved immediatly. Ask for the response w/in 5 days.

If this does not work, follow up with a request for a TEAM meeting to discuss and resolve the issue. Give them 3 days and times that work for you.

Remember to keep a log of all phone calls and a copy of all letters.
