the school we are zoned for is failing miserably with a 15% math score average. I am told that their are no exceptions for him to go to school out of district. i am shocked about this does anyone know of any legislation out there to protect us? or am i forced to send my child to a school that is failing in every subject?

There is no choice in petersburg. your only choice is private school.

try a charter school. I lived in Batimore City when my daughter started school and that's what I had to do. Many charter schools are not zoned and there are alot of them so you can choose. It beats private school.

Unfortunatly, I am to familiar with the answer to this particular question. Over this past Summer I tried "everything" to take my kid out of the failing High School, and under no uncertain terms was told NO,, by all. All including the Dept. of Education in Washington D.C. WHY? Because with Virginia being a Commomwealth State, appartantly they get to not only abide by the laws they choose(sarcasim) but when it comes to the educational level they are given power to choose or emplement the laws on a local and district level. What this means is that the surrounding school districts such as Prince George, Hopewell, Colonial Heights, Chesterfield, have the right to say we dont have to take your children under the No Child Left Behind law because we choose not to at a local level. Is this fair? Absolutly not, but is it legal? Yes! I was told by the Superintendent of Chesterfield Public Schools that even if the President of the United States called him and said to put my child in his school that he could say No. And he was right he could. This is not only one of the biggest get overs out there it serves our children no good at all!!

Just a note: in our district, enrollment requires "proof" of address. Here's what it says on the website:

"Proof of Residency is required. The following documents meet the requirements to establish residency—at least one document from each section below or two documents from “B”
•Section A)
California Driver’s License/ID Card and vehicle registration showing the new address, or
A phone bill, or
Personal checks or bank statement with the new address imprinted, or
Letter from the property owner or manager of the residence, or a lease/rental agreement
stating that you are in residence with your child, or
A letter (Affidavit of Residency) from an adult with whom you reside (who can also prove
residency by these requirements) or
Copy of W-2 form from your employer with the new address, or
Insurance documents with the new address, or
Cancelled checks written for house payments/lease/rent, or
Piece of mail forwarded from your old address to your new address.
** AND **
•Section B)
Two utility bills, or
Business/official mail (i.e., Welfare, Social Security, FEMA, IRS, California State Franchise
Tax Board, credit card or medical bills, divorce papers, custody papers, subpoenas,
restraining orders, traffic tickets), or
House insurance, property tax bill, or
Escrow papers (within 30 days of closing), or
Legal document from a law enforcement agency or court.

As you can see, it is precise and stringent. I doubt that just using someone's address will do the trick. I suggest that you go onto your district's website and see what documentation you will need.

I am struggling with the same problem. I want to have another baby, but if we have to pay tuition somewhere, I am not sure we can afford a third child. I am in Missouri, and one of the supers of buses told me that you could really send your kids to any location and that no one really checks you out unless you have problem kids. If anyone knows anything to add to this, please let me know because I plan to just use a friend's address and send my kids to one of the better schools and hope to have a third child.
