They have the best (and sometimes only) education attorneys on retainer. It is not an exacerbated expense to fight you in court whereas the alternative is a prolonged and higher expense of educating your child over the years. If they provide for your child, they fear the flood gates will open to more and more. They no longer teach to the child in "regular" ed...let alone our special needs kids. Bottom line is cost-benefit analysis on their part...IMHO.

An IEP also offers protection re: expulsion. Even if a child with an IEP is expelled, the school is still obilgated to educate them.

Just my opinion - but to answer the question, why do schools push 504's over IEP's?

IEP's offer more procedural protections. Most states clearly define time frames, responsibilities and complaint resolution process. IEP also provide for more services, instruction and modification that cost schools resources - time, money, teachers.

504's do provide protection - but are harder to hold the school accountable. I think that many schools offer them to get the parents off their backs.

504 eligible children can be served by special educaation if they need it without and IEP. Many schools don't get this. Get in touch with your local Office of Civil rights. They may be able to let the district know if they don't believe you.

I just posted a question asking why the schools are readily pushing 504 plans (which is not enforced at our son's high school in League City, Texas), but deny students special ed services? Are there monetary incentives for doing this? How can they sleep at night?
Our son's Drs. have filled out MANY "Other Health Impaired" forms and his prior excellent grades have been replaced with poor ones. The school has even "bumped" his grades from failing to passing to make it appear there wasn't an "academic" or "educational need" and the guys at the administration office are aware of this. What ever happen to putting the needs of the child first? Why is my child being left behind? We have had so many meetings with this school/district starting from September and it's still being dragged out at MY SON'S expense!
Does ANYONE know why our district is willing to spend so much money on court costs and attorneys when they deny these services but they DENY DISABLED CHILDREN THE RIGHT TO AN EDUCATION BY DENYING THEM ACCESS INTO THE SPECIAL ED PROGRAM WITH QUALIFIED SPECIAL ED TEACHERS???? I FEEL OUR SCHOOLS HAVE GONE HMO!!!!!
